Sexual Offences Act 2003

What areas do you specialise in?

My area is Voluntarily Intoxicated Consent (read my published article on it here), and its related problems with convictions. The definition of consent can be seen here at the Crown Prosecution Service (“CPS”) website.

What is the purpose of this page?

As one of my specialist subject areas, this page is a dedicated news feed to all sexual offences reported in English, globally.

What does it do?

It searches Google for the latest offences committed by individuals, as reported by various elements of the media. None of the content can be verified by the site owner, if you wish to rely on any results contained within, you must conduct your own due diligence.

I don’t wish to see offenders, I’d rather see how the Act is applied; what should I do?

If you are seeking a more technical view of sexual offences per the Sexual Offences Act 2003 click here for Google news. It will take you to a feed that will provide offences committed not only by individuals but by organisations, such as brothels.

I would like verified statistics please, what would you recommend?

A great place to start is Justice.gov.uk. You will find countless reports detailing many different aspects of sexual offences. Click here to visit the site and a ‘ready-made’ listing of convictions.

What is the legal definition of rape? Is there a useful single reference source?

The legal definition can be viewed at the Crown Prosecution Service (“CPS”) website. For example, S.41 can be found here within the ‘Rape Manual’.

How are offences prosecuted under the SOA 2003?

As a guide to sentencing of sexual offences in England and Wales (only), and the latest development of the law in relation to the Human Rights Act 1998 (incorporated via ECtHR) see the Crown Prosecution Service (“CPS”) website. It provides clear guidance and will assist the reader as to how the CPS justify their charges.

When the media report ‘images were indecent, some at level 5′, what does that mean?

What Units are set up in the UK to tackle Child Exploitation?

CEOP provide the following statement “The Child Exploitation and Online Protection (CEOP) Centre is dedicated to eradicating the sexual abuse of children. That means we are part of UK policing and very much about tracking and bringing offenders to account either directly or in partnership with local and international forces”.

How do other countries, such as the USA, deal with offenders?

I am often asked this question. It is different in each state in the USA. Texas, for example, has a public database of offenders. Although they stipulate “Pursuant to Texas Code of Criminal Procedure Art. 62.301 and judicial orders, not all offenders are available on the public access sex offender database

There are also several caveats regarding the information and you should read them carefully.

They provide: “Pursuant to Texas Code of Criminal Procedure Art. 62.005, the Texas Department of Public Safety (DPS) establishes this website as the official internet public access to the DPS sex offender registration computerized central database
